Alternative Dispute Resolution Services
Our Alternative Dispute Resolution ("ADR") services allow parents and education agencies to affordably resolve disputes without the need for costly litigation. Some parents and education agencies use ADR as an opportunity to work things out without involving paid representation.
KPS4Parents offers ADR in the form of IEP meeting facilitation and mediation services. Our staff can serve as facilitators of the IEP process without taking sides in any disputes to ensure that both parties are heard and that the concerns of each are addressed.
We also offer Mediation Only services for unique situations where utilizing publicly available mediators is not appropriate to the circumstances, such as when the parties wish to be represented but are not looking to file for due process. Currently in California (and, likely, in other states), if the parties wish to be represented in mediation, it is necessary to file for due process in order to receive publicly available mediator services. This includes representation by lay advocates and other non-attorney representatives.
By making ourselves available to provide unbiased special education mediation services, we keep Mediation Only open as a viable option for those parents who don't feel comfortable negotiating settlement without professional help but are hoping to avoid due process.
